1. Acceptance of Terms

By accessing or using ProLens AI, you confirm that you are at least 13 years of age (or the higher minimum age required in your country), have read and understood these Terms, and agree to be bound by them. If you do not agree, please do not use the Service.

2. Description of Service

ProLens AI is a mobile application that provides AI-powered photo enhancement services. The Service uses artificial intelligence to analyze and enhance photographs uploaded by users.

3. User Content & Copyright

You retain full ownership of all photographs and content you upload to ProLens AI. By using the Service, you grant ProLens AI a limited, temporary, and non-exclusive license to process your content solely for the purpose of providing photo enhancement services. We do not claim ownership of your content.

You are solely responsible for ensuring you have the rights to upload and process the photographs you submit. You must not upload or process content that infringes the intellectual property rights of any third party.

You must not use the Service to create misleading, deceptive, or manipulated images (such as deepfakes) intended to deceive others or violate applicable laws.

4. Privacy and Data Processing

A resized version of your image may be temporarily transmitted to third-party AI services (including Google Gemini) solely for analysis purposes. Images are not permanently stored on our servers. Brand profile information is stored locally on your device.

6. Credits and Purchases

ProLens AI operates on a credit-based system. Credits are consumed when photos are processed.

• Free plan: 20 credits upon registration. Limited export resolution and ProLens AI watermark.
• Starter pack: One-time purchase of 100 credits. Credits do not expire.
• Pro pack: One-time purchase of 300 credits. Credits do not expire.
• Premium subscription: 750 credits per billing period. Unused subscription credits expire at the end of each billing period and do not roll over.

One-time credit purchases accumulate and do not expire. Subscription credits refresh each billing period and unused amounts are not carried forward.

Purchased credits are non-transferable and cannot be exchanged for cash.

7. Subscriptions and Auto-Renewal

To cancel on Google Play: Google Play Store → Account → Subscriptions → ProLens AI → Cancel.

To cancel on Apple App Store: Settings → Apple ID → Subscriptions → ProLens AI → Cancel.

8. Payments and Refunds

Purchases are processed through Google Play Store or Apple App Store. Refund requests are subject to the refund policies of the platform through which the purchase was made. ProLens AI does not directly process payments and cannot independently issue refunds outside app store policies.

Unused credits, subscription benefits, and purchased credit packages are non-transferable and non-refundable except where required by applicable law or app store policies.

9. Watermark and Export

Free and guest users: exported photos include a ProLens AI watermark.

Paid users (Starter, Pro, Premium): may add a custom brand watermark (company name, phone, logo) to exported photos.

You are responsible for ensuring that watermark content you add (including logos and text) does not infringe third-party rights.

10. Prohibited Uses

You agree not to use the Service to:

• Process photographs you do not own or have permission to use.
• Create deepfakes, misleading, or deceptive content.
• Attempt to reverse-engineer or extract AI models from the Service.
• Use automated tools to create multiple accounts or abuse the credit system.
• Upload illegal, harmful, obscene, or offensive content.
• Violate any applicable local, national, or international laws.

We reserve the right to suspend or terminate accounts engaged in prohibited uses without prior notice.

11. DMCA & Intellectual Property Complaints

We respect intellectual property rights. If you believe content available through our Service infringes your rights, please contact us at a.ince.mugla@gmail.com with a description of the infringement, the location of the content, your contact information, and a statement of good faith belief that the use is not authorized.

12. Limitation of Liability

To the maximum extent permitted by applicable law, ProLens AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service. ProLens AI's total liability shall not exceed the total amount paid by the user during the twelve (12) months preceding the event giving rise to the claim.

13. Force Majeure

We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including internet outages, cloud service disruptions, third-party service failures (including Firebase, Google Cloud, or Google Gemini), natural disasters, or governmental actions.

14. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

15. Termination

We reserve the right to suspend or terminate your access at any time for conduct that violates these Terms. You may delete your account at any time through the app or our account deletion page.

16. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes through the app. Continued use after changes constitutes acceptance of the new Terms.

17. Governing Law

These Terms shall be governed by the laws of the Republic of Türkiye. Any disputes shall first be attempted to be resolved through good-faith negotiation. If not resolved, the courts of Muğla, Türkiye shall have exclusive jurisdiction.
